GENERAL PROCUREMENT CONDITIONS

PURPOSE AND SCOPE

All the products that are offered through the "La Librería UPV" web abide by the following general conditions of sale:

Acceptance and proof of acceptance

The use of the services offered through "La Librería UPV" by customers implies adherence to these general conditions at the moment in which they issue a purchase order.

Prices, Payment Method, Delivery and Cancellation

Prices

The prices applicable to each product are the ones indicated on the website on the date of the order, including the Value Added Tax (hereinafter, VAT). However, in accordance with the provisions of Law 37/1992, of 28 December, which regulates such tax, the transaction may be exempt or not subject to the aforementioned tax depending on the country of residence of the buyers and their condition (employer / professional or private individual). Consequently, in some cases, the final price of the order may be altered with regard to the one shown on the website.

In the case of deliveries of goods that take place in countries which do not belong to the European Union, "La Librería UPV" shall not bear the cost of taxes and customs duties of each country, being the recipient of the product responsible for bearing such costs.

Free publications shall be exempt of any price or tax and shall be clearly indicated on the website, and the customer may download them free of charge.

The shipping costs and VAT applied are always indicated in the order.

Payment method

Purchases can be paid by any of the means of payment listed below:

  • Credit card: Available for all countries.
  • Bank transfer.
  • In the case of "Store pickup": In addition to the above options, the goods can also be paid at the Editorial UPV shop located in the UPV - Vera Campus Site (Valencia), by cash or by card.

When the payment for the purchase of a book through "La Librería UPV" is made by credit card, through the payment gateway of the banking entities with which the corresponding payment service contract has been established, the Universitat Politècnica de València shall not be responsible for the security of the transaction, which shall be supervised by the payment services of the banking entities. They must enable a secure site (https).

Under no circumstance shall the files of the Universitat Politècnica de València require or demand the credit card details; they may only be requested by the banking entities, which will be responsible for the security of the transaction. The Universitat Politècnica de València denies all liability in the event of fraud or computer scam by third parties.

Delivery

Deliveries may be made:

  • At the Editorial UPV shop located in the UPV - Vera Campus Site (Building 2F- Editorial UPV - Camino de Vera, s/n, 46022 Valencia)
  • At the shipping address indicated by the Customer, if there is a delivery service arranged for that address .

Customers may select the desired shipping method from the ones available for their shipping area. "la Librería UPV" shall ship the orders to its customers through the designated express courier companies or, when applicable, through the State Postal Service. The delivery date at the Customer's address shall depend on the availability of the chosen product and the shipping area. The delivery time may vary depending on the specific circumstances of each order. When making the shipment and provided that the courier company provides such service, "La Librería UPV" shall provide a Tracking number to Customers, which shall allow them to know (through the Transport Agency website) the status of their shipment.

Purchase procedure

The only requirement for the purchase of the products offered in "La Librería UPV" is to fill in the purchase form with the personal and payment information.

Once a Purchase Order has been received, "La Librería UPV" shall immediately send a purchase confirmation to the email address indicated in the Purchase Order, which shall be deemed to have been accepted by the Customer to formalise the purchase. From that moment on, the Customer shall undertake the commitment to acquire the requested books. The Purchase Order shall then be attended to, except in the event that the information provided in the request is incorrect or incomplete.

Transaction regime

Both "La Librería UPV" and the Customer assume their responsibilities in accordance with the current regulations of the information society services. And in compliance thereof, the Customer of "La Librería UPV" shall be entitled to receive the invoice of all the purchases made, as well as the return of those products that have arrived defective or in poor condition for transport reasons. Likewise, the Customer shall have the right to make the claims deemed necessary under the regulatory legislation of electronic commerce.

Cancellation

"La Librería UPV" shall guarantee Customers the possibility of cancelling their order free of charge if the cancellation is communicated before the order goes through the processed phase. Otherwise, Customers must receive the order before they can process its return (see RETURN PROCEDURE).

Customers shall have a maximum period of 15 days from the receipt of the order to make a return.

Return procedure

Customers shall receive an email from "La Librería UPV" with the instructions they must follow in order to return the goods; if the return is made because the products have arrived in poor condition, "la Librería UPV" shall bear the cost of the return, which must be performed following the instructions that are detailed in the email. In any other case, the Customer shall bear the expenses of the return. "La Librería UPV" shall only accept the return of products that have not been opened or used and that are kept with their original seal or packaging.

PERFORMED TRANSACTIONS

The Universitat Politècnica de València shall keep the electronic documents in which the transactions carried out through "La Librería UPV" are formalised to comply with their legal obligations.

Personal data and commercial communications

In accordance with the provisions of Organic Law 15/1999 of December 13 on the Protection of Personal Data, Customers are informed that the personal data provided shall be included in a file owned by the Universitat Politècnica de València for the management of customer orders.

Customers may exercise the rights of access, rectification, cancellation and opposition by request addressed to the General Secretary's Office of the Universitat Politècnica de València located in Camino de Vera s/n 46022 Valencia.

They may also revoke the consent given for the sending of electronic commercial communications by sending an email to info@lalibreria.upv.es.

Intellectual and industrial property

The intellectual and industrial property rights over the works, brands, logos, and any other element eligible for protection contained in "La Librería UPV" website are the exclusive property of Universitat Politècnica de València or third parties that have authorised their inclusion in the website. The unauthorised reproduction, distribution, commercialisation or transformation of such works, brands, logos, etc. constitutes an infringement of the intellectual and industrial property rights of the Universitat Politècnica de València or the owner thereof, and may result in the exercise of any judicial or extrajudicial actions that may correspond to them in the exercise of their rights.

Likewise, none of the books acquired through "La Librería UPV" may be reproduced in whole or in part or computer processed or transmitted in any form or by any means, electronic or mechanical, including photocopying, recording or any other means, without prior permission in writing from the publisher and, where appropriate, the author.

Jurisdiction and applicable law

In the event that any conflict or discrepancy arises in the interpretation or application of these contractual conditions, the Courts and Tribunals that, as the case may be, will be aware of the matter, will be those established by the applicable legal regulations in matters of competent jurisdiction, which addresses, in the case of final consumers, the place where the obligation is fulfilled or that of the domicile of the buying party.

In the event that the purchase is made by a company, both parties submit, expressly waiving their right to any other jurisdiction, to the Courts and Tribunals of Valencia (Spain).
